Our general terms and conditions
1. subject matter of the contract
The object of the contract is the provision by APART AG of hotel rooms, seminar rooms, conference and meeting facilities, banqueting facilities, catering and other services necessary for the organisation of the respective event. The HOTEL APART Rotkreuz and the PERRON NORD restaurant belong to APART AG.
2. reservation
The reservation agreements and any amendments thereto relating to services provided by APART AG shall only become binding on the hotel once they have been confirmed or reconfirmed in writing by the hotel and the customer.
3. indication of programme and number of participants
3.1 The organiser shall provide APART AG with the detailed programme, details of the set-up of the premises and technical equipment and all information required by APART AG to ensure the smooth running of the event no later than 14 days before the event.
3.2 APART AG shall receive the exact number of participants from the organiser no later than 5 working days before the start of the event (seminars, meetings, banquets, etc.). This shall serve as the basis for calculating the final invoice.
3.3 The customer undertakes to inform APART AG in writing of the final guest list for room bookings (groups of 10 or more persons), including personal details of the guests, 2 working days before check-in and for catering services 5 working days before the event.
4. cancellation of the reservation
Seminars / meetings / banquets
4.1 Cancellations of reservations for seminars, congresses, conferences, lectures, banquets and other events must be notified to APART AG in writing by the customer as set out in point 3. If the reservation is cancelled in full and APART AG is not responsible for this, it will charge the customer the following cancellation fees for the reserved service:
15 – 20 days before the event: 50%
3 – 14 days before the event: 75 %
0 – 2 days before the event: 100 %
Cancellation of reservations for events is only possible free of charge up to 21 days before the confirmed event date.
4.2 If APART AG has reasonable grounds to believe that the event or arrangement may jeopardise the smooth running of the business, the safety or the reputation of APART AG, it shall be entitled to cancel the reservation agreement at any time without compensation.
Hotel rooms
4.3 Cancellation of the room reservation free of charge is possible at the latest by 11.00 a.m. (CET), one day before arrival, otherwise the first night will be charged at 100%.
4.4 The following applies to cancellations of group reservations of 10 rooms or more:
0 – 10 days before: 100% of the lost room revenue
11 – 14 days before: 75% of the lost room revenue
15 – 30 days before: 50% of the lost room revenue (payable 30 days before arrival as advance payment)
Cancellation for room allotments of 10 rooms or more is only possible free of charge up to 31 days before the confirmed arrival date.
5. internet / websites
All information published on the Internet (prices, online calculations, reservations, etc.) is without guarantee. APART AG accepts no liability for Internet errors, damage caused by third parties, imported data of any kind, in particular viruses, worms, Trojan horses, etc.. The error-free functioning of hardware and software cannot be guaranteed. The Internet pages may contain technical inaccuracies or typographical errors. In no event shall APART AG be liable for any direct, indirect, special or other consequential damages arising out of the use of the APART AG website or any website linked to it. Any liability for loss of profit, business interruption, loss of programmes or other data in customers» information systems is also excluded.
